LLM EC ambition law - Essay ExampleWithin the UK Articles 81 and 82 EC have been incorporated into the Competition Act 1998 (CA). The aim of these articles and the CA is to prohibit agreements, business practices and behaviors that have, or are intended to have, a damaging effect on competition in the UK (in the EU for the EC Articles).1 Article 81 prohibits any dealings that will distort competition within the EU, which complicates any agreement from insider trading through to companies discriminating to lend goods or services on the basis of preferential businesses. The change and supply of goods and services should be open to all members of the class that the company deals with. Also the sale of goods and services should be based on fair and open grounds, examples that the Office of Fair Trading and the EC use to illustrate anti-competitive agreements, in addition to cartels, includeThe basis that the EC has used to identify what grounds are anti-competitive can arguably be de termined as not economic, but more socially based. On economic grounds could such agreements as shown above not be a way to create a more competitive market, because if the deport competitors agree to limit output does this not open the door for new businesses to open up in order for supply to meet the demand. Therefore it is soi-disant whether the current system of law is really dealing with what is economically competitive on economic grounds3. This is even more apparent with Article 82 EC, which deals with identifying what equates to black behavior by a company in respect to EC competition law. In order to be abusive under the company essential be in a supreme position, which raises a question on the fairness of this article because if a company is not in a dominant position why is it not abusive This seems to be more of a social rather than an economic factor, because it means that if you are NOT a correctly and dominant company you can do as you wish.4 This illustrates th at the grounds that EC law is determining on abuse in fact favors one heavens of the economy over others, i.e. the underdogs. Is this not an abuse of competition law, because in certain instances dominant companies are a natural part of the industrys landscape, e.g. water, natural resources and fuel. This indicates that the current speak to to determining a breach of competition law is in fact ironically a breach itself. The definition of dominance comes from the cases of United Brands5 and Hoffman-La Roche6 where the ECJ (European Court of Justice) delimit the concept of dominance asA position of economic strength enjoyed by an undertaking which enables it to prevent effective competition being maintained on the relevant market by affording it the power to behave to an appreciable extent independently of its competitors, customers and ultimately of its consumers.7It is commendable that the ECJ indicates the need to protect the interests of the consumer however is this determinat ion on the basis of the economic grounds of

Should Veil Be Judgemental In Islam Essay Example | Topics and Well Written Essays - 750 words

Should Veil Be Judgemental In Islam - Essay ExampleIt is a sacred fact that in Islam, Purdah is supernumerary for every woman approaching the age of puberty or who has already reached it. Many people and especially the non-Muslims sometimes tend to believe that Hijab is in a stylus restrictive or rigid and is aimed at keeping the women inferior to men. However, nothing could be far from the truth. Ignorance and misunderstanding happen to be the leading causes female genitals such beliefs. Purdah on the one side protects the women from exploitation from the strangers and on the other hand enjoins on the women the conditions of morality and purity (Guindi, 1999). Without in any way trying to dilute or disrespect the spirit of this great religion, with all due humility, it will also be true to conclude that many a women who may not adhere to purdah in the strict sense of the term, may still show respect for the innate morality and purity intend by the true intentions behind the caus e of purdah. Many people believe that purdah and Hijab ought to be binding on women and any women who refutes the constraints of purdah and Hijab happens, not to be a believer in the true sense of the word. However, though such views do have relevance, it would not be wrong to say that Islam in no way tends to confine and limit the socio-economic status of women to the mere constraints of purdah and Hijab, and has multiple other women centric aims and ambitions, allowing for the full development of a females personality. Considering that zippo is perfect, there may not be a famine of women who though not affiliating to purdah as interpreted by many, may be adhering to a range of Islamic values and morals. With the passage of time, as women are moving forward with the influx of globalization and the opening up of societies, there is no dearth of Muslim women who not only qualify to be called the career women and working mothers, but who also harbor a deep seated intention to tutor Islamic values in their personal and professional life and identify themselves as practicing Muslims (Abdo, 2000). In fact, the spread of the sophisticated education has opened up the minds of the contemporary Muslim men and women, and one particular thing about the modern Muslim women is that they are increasingly getting reconnected with Islam (Abdo, 2000). Yet, by the virtue of being modern Muslim women, these women also have a pragmatic need to be able to be spry and practical in the wake of the demands being enjoined on them by their professions. Thereby, demoralizing such women by interpreting the requirements of purdah in a strict and conservative way will certainly not be an act of faith, especially more so when these women have an innate and deep seated respect and allegiance to the Islamic values and morality. For instance, there may be women who may don a veil in their public life, but, who may smoke, drink and dress in an unsuitable manner in their private life, when goose egg is observing them. In contrast, there also may be women, who may wear a short scarf out of the need of being mobile and professionally effective, yet, who have the potential to be religious and follow the Gods will in all possible ways except for the scarf. Legacy Business Project Essay Example | Topics and Well Written Essays - 500 words

Legacy Business Project - Essay Example end legacy art project on Cliffs hardware instilled in me clear knowledge about systems and agency or stewardship surrounding family caperes. terminate the project made me realize the family business system is comprised of three mutually dependent and overlapping groups, which include the family, business and ownership. The overlap creates numerous groups within the family business with varying opinions, interests and objectives. Besides family owners, there are family members, family employees, family owner-employees, non-family owner employees as well as non-family employees. For example, we found out that Cliffs hardware family business is managed by the family members including Martha Asten and Terry Asten Bennett, who has been Cliffs Variety manager since the 1990s. There are also employees, who are not part of the Asten family. Based on the research, it was clear that the luck of a family business transitioning successfully from the fir st to the second generation is usually slim and grows slimmer as the business progresses to successive generations.Like in every business, family business is not immune to the issues of stewardship of agency. The interest of the family business must be protected because the overlapping groups with varying interest and opinions try to push for their own ends. A reasoned family system is usually advantageous to the family business while a broken family system will negatively impact the health of the family business. Trust is often a critical ownership tool in family businesses. Holding regular meetings is crucial for the growth and survival of legacy businesses because it creates a platform for discussions beyond the confines of boardrooms. For example, in our project during our attempts to reach Martha, a second-generation member of the family business, we were told by Frank, an employee at Cliffs that Martha and other family

Love at first sight Essay Example for Free

Love at first sight EssayAdolf Hitler was a very famous person that was in the Holocaust. He was a very unrelenting person who thought that eitherone who wasnt a pure daub German was lower than him and filthy. He put a lot of people through visitation and pain. He didnt even know if the people he was killing could be nice and pleasant. All he cared about was that they werent pure blooded Germans. Adolf Hitler was born on the 20th of April, 1889, in a town named Braunau an inn, Austria. He was baptised catholic and his dream was to become a priest and to peruse subterfuge school. He came from a divorced family, his laminitis died in 1903. Hitlers mother died when he was 18 years old, 1907. Hitlers grandfather is believed to be Jewish and succession in Vienna he had two close Jewish fiends. Hitler alike served in World fight 1. When Hitler was a child he was brutally step by his father and lost 3 of his siblings when he was a young boy, 2 from diphtheria and one during ch ild birth. This must have been very traumatic and awkward for a young boy to grasp. His mother and father were divorced and his father has 2 marriages after his mother.Hitler had only been 14 when his father died of pleural haemorrhage. He briefly after his fathers expiration left school due to him suffering from lung infections. Hitler had a hard and traumatic childhood and when he sour 18 his mother died from terminal breast cancer while being treated by a Jewish doctor. It is believed that Hitlers grandfather was Jewish and after his mothers death he became certain for what he wanted to become and moved to Vienna to become an artist, after years before being rejected. Hitler met two Jewish workforce and became close friends with them. This is why many of Hitlers generation and the generations there after dont understand why he turned against the Jewish, could it be mental issues within his promontory and thoughts after having such a rough childhood? What could have been the main origin for Hitler to turn against Jews in particular? Hitler began growing offense for, non the Jewish in particular but rather against the cruel world that he lived in. There are many that believe this argument is not true because they believe Hitler grew angry after his mothers death, because it was a Jewish doctor, Dr.Edward Bloch who put her with excruciatingly painful as well as expensive treatments and surgery, and yet she still died. As well as his hidden shame for his grandfather being Jewish. Others believe that he was angry at his father for the abuse, pain and suffering he put him trough and wanted to get back at the world in his own twisted way. What could have been the reason for someone to act so mentally ill, that theyd want to exterminate an entire race? I believe that Hitler was not only physically modify but mentally too that he may have lost his mind. There are theories that Hitler turned against the Jewish population because its believed they killed Jes us delivery boy and he was a Christian. When Hitler was 18 he moved to Vienna to peruse his passion for becoming an artist, he lived a very poor life accompaniment off of hid fathers small inheritance and an orphans pension. He became penniless and soon was homeless he slept in a different place every night. It is during this time that people believe he became prejudiced about Jewish people, developing his knack for politics, and forming his debating skills.Adolf Hitler, two of his closest friends at this time were Jewish. He also admired Jewish art dealers and Jewish operatic performers and producers. However, Vienna was a centre of anti-Semitism, and the portrayal of Jews as scapegoats (the people who bear the blame) with stereotyped attributes (something that someone tell that was not true about them but people believed) fascinated Hitler. What could mentally have been wrong with Hitlers mind that hed turn so violently against his own family and friends? In May of 1913 Hitler l eft Vienna and went to Munich, which is the capital of Bavaria, to avoid military services. In January the police came to him with a notice from the Austrian government. It jeopardise a year in prison and a fine if he was undercoat guilty of leaving his native land with the intent of avoiding conscription (enrolling for the military). Hitler was arrested set then and taken to the Austrian Consulate. When he reported to Salzburg for duty, he was found unfit too weak and unable to bear arms.Hitler served in World War I. He was enlisted in the Bavarian army. aft(prenominal) less than two months of training Hitlers regiment saw its first combat near Ypres, against the British and Belgians. Hitler closely died that day and many others. He was awarded two Iron Crosses for bravery. In October of 1916 he was wounded by an enemy shell and moved to a Berlin area hospital. After recovering, and serving four years in the service, he was temporarily blinded by a mustard gas attack in Belgiu m in October 1918. communistic revolts shook Germany while Hitler was recovering. Some Jews were leaders of these revolutions and this was part of Hitlers hatred for Jewish people. Could Hitlers recovery stage have been the time that he started to speckle plans to exterminate the Jews, it may be possible that when he was injured and had to recover that he may have become mentally ill. It is also possible that he blames the Jews for becoming injured in the first place and this may have been the last straw for him.It is impossible to know what was running through Hitlers mind but its more then certain that for one human to hate and despise a race so much to want to demolish them is not human nature, it is not normal for a human to have any thoughts, plots or motivation towards exterminating one person let alone almost a billion people. There are many theories that Hitler was an ill man and wanted more then to exterminate a race but exterminate a nation for his own personal gain, even though this is possible to know there are still theories and accusations and this makes knowing the truth difficult.Hitlers dictatorship began in 1933, when he joined and created the Nazi party. His leadership, many believe, made him more power hungry then ever, and made him more mentally ill then before. Hitler died in 1945, after committing suicide. There are theories that he couldnt handle his life anymore and wanted an easy way out, others believe it was his childhood that made him mentally ill and traumatised, and others think it was the guilt of killing millions of people for no reason. What could drive a human to taking their own life? Now you see that Hitlers life was very sad, like many others at that time. The way he was treated when he was young, his family life, might have affected the way he turned out to be an adult. Which is why many believe he was a strong and ruthless dictator due to his childhood, but this is still not a good enough reason, in my eyes, for someone to commit mass murder and attempt exterminating a race. Hitler was humanly unstable and was not fit to dictate or run a country which led to his genocide of the Jews and suicide. Relational Skills Reflection Paper Essay Example for Free

Relational Skills Reflection Paper EssayThe purpose of this paper is to allow me, the learner to analyze and reflect on a video created between an actor and themselves. Using my friendship obtained I was to effectively incorporate trust, respect, honesty and effective communication, as they are key principles in establishing a relationship with a client (RNAO, 2002). During this live on, I encountered an issue that I believe is significant in my increasement as a nurse. I was move into a scenario involving a 47 year old affected role named John, who was waiting to be discharged aft(prenominal) suffering his first content attack. Finding the patient roles quietly sitting in a chair watching the floor as I entered the room, I felt the necessity to be in the moment with him. The issue that seemed significant to pay care to in this scenario was my patients feelings of being overwhelmed by his medical exam condition and the changes that needed to be made (Appendix A). Sittin g within good distance and showing respect fit ashes language showed him respect, while acknowledging he had my full attention was displayed to the patient by making comments much(prenominal) as yes and I understand (Appendix A). Through the use of open-ended questions, I was capable to identify what was meaningful and concerning to john.John showed a lot of concern around his exponent to care for himself so this doesnt happen again, and being able to support his family (Appendix A). Knowing his concerns, I was then able to acquire the necessary knowledge needed to participate effectively in our nurse-client relationship (RNAO). This watch has allowed me to interrupt further in my role as a nurse. My patients comment on how our encounter gave him more encouragement to face his challenges was proof that my communication methods were effective in developing a remediation relationship (Appendix A). The opportunity to set aside my own concerns and focusing on the patients, allowed me to be in the moment with the patients. In those moments, the pay back helped me require a better nurse as my actions made me feel more confident after each successful encounter. Watching his facial expressions and drafting in his positive responses allowed me to watch him develop confidence in my ability to care and in turn, allowed me to develop confidence in myself (Appendix A).The significant actors in this experience were the individual playing the part of John and myself, the nurse attending to the patients needs. My role in the scenario was to identify the concerns of the patient and help them to obtain knowledge. Providingresources for my patient gave him options that were specific to his concerns such as a well balanced diet and proper exercise. The options of meeting with a nutritionist to help make healthy meal choices, and with a physiotherapist to help develop custom exercises to take with him on the road further John to change his routines (Appendix A). Taking note of my patients feelings of being overwhelmed by his heart attack, I was able to give him some comfort when offering to find an individual recovering from a heart attack that would be willing to sit conquer and share their life stories and methods of coping (Appendix A). The patients role in this experience was to help create a alterative relationship.I first observed my patient with her ordnance and legs crossed and staring down at the floor with concerned look on his face (Appendix A). Comparing the first image to the end of the scenario showed an individual that was enkindle in making a change, a smile on his face and as he stated, an encouraged intuition of his health (Appendix A). The client was in need of direction and help with making the appropriate changes to ensure a healthy lifestyle after having his heart attack. I was able to provide her with resources such as a nutritionist, physiotherapist and social support to adjust to life changes (Appendix A). While meeti ng the needs of my patient, I was successful in completing my own private needs. Coming into the experience with knowledge of possible resources available, the anxiety present upon introduction had disappeared after gaining acceptance from my patient through and through effective communication. The development of a therapeutic relationship allowed both the patient and I to gain from the experience. The patient left feeling encouraged and satisfied, as I felt successful and confident in how I handled the military position (appendix A).Before the taping of the scenario began, I was trying to achieve the perfect scenario while presenting a professional image of a nurse. I acted the demeanor I did due to the lack of experience in the spotlight and I allowed my nerves affect my thought process. This is demonstrated throughout the entire video as I kept returning to the same question are there either concerns you buzz off, and trying to work the patients problem instead of helping them understand and eff with the emotions that are attached to the experience (Appendix A). My feelings, thoughts and responses during this experience were influencedby my personal view and the presence of my preceptor located me in a nervous state to which I became unsure of how to respond properly to my patients thoughts. This experience allowed me to feel capable of my skill levels and feel confident as a nurse. Overall this scenario showed perception of my growth through the friendly gestures and facial expressions of the patient.Anxiety and stress diminish communication, interpersonal effectiveness and empathy within a nurse-patient relationship (Beddoe and Murphy, 2004). Lack the knowledge and understanding of why I am feeling this anxiety, even with positive reflections on my experience, allowed me to evaluate what I did wrong. Future encounters will help me to reflect on the scenario and blindside my anxiety forrader it has an effect on my actions. Having a limited amount of empirical knowledge made it challenging to let the patient know exactly what to expect after having a heart attack and what daily routines have to be adjusted. Obtaining empirical knowledge from my education regarding the components of a nurse-client relationship reminded me that I needed to place the designer into my patient and develop respect and trust within the relationship (CNO, 2004).Personal knowledge was limited in this scenario as it was my first time being placed in the spotlight with a patient and I was unsure of how everything would unfold. Introducing my aesthetic knowledge was shown when I offered to find John an individual recovering from a heart attack that he could speak with (Appendix A). Throughout the experience, I became more aware of the patients feelings as I picked up on Johns overwhelmed feelings and concerns around providing for his wife and son (Appendix A).This perception of the experience is seen as John believe that he should have seen the heart a ttack coming before it occurred (Appendix A). He stated the he felt encouraged by this experience and felt he had more options to seek. The wife was more of a background actor, but was said to be a sweet woman, who has helped a lot throughout the experience (Appendix A). Valuing ones beliefs and concerns based on an experience is something all nurses should consider. Giving John sixfold options and resources to consider instead of telling him what he has to do, have given him the power to make all the necessary changes within his life with the help of his wife and son (Appendix A).If I was given the opportunity to be placed in a similar situation in thefuture, I believe that my anxiety would still be present, but more control over the situation would be noticeable due to the knowledge I have developed on therapeutic relationships. The relationship skills that I could have performed differently during this experience, was my self- sensory faculty of human emotions. My nerves had pla yed a role in distracting my train of thought when trying to be in the moment with the patient. Repeatedly asking the patient if he had any other concerns he would like to address may have given him the feeling of being rushed and that I was not fire in how he was feeling emotionally (Appendix A). On a few occasions, I would finish my patients sentence for him as I felt he was stuck for words, this may have allowed the patient to know I was listening to what he was saying, but also might have given him the idea that I was being rude (Appendix A).During the introduction act of the experience, my patient told me he was in the hospital due to a heart attack. Empathy is the appreciation of the patients emotions and expression of awareness of what they are presenting (Haslam, 2007). My nerves caused me to overlook his feelings and just cover into asking him about any concerns he might have with his state of health (Appendix A). It is possible to slip into a task-and time-orientated wa y of thinking to get jobs done, thereby neglecting effective communication with patients (Cocker, 2008).Consequences that may have developed from overlooking the patients feelings was the challenge of developing a closer relationship with the client as I was interested in obtaining information to help me solve his problems. Rushing my patient through the experience may have caused him to close himself off from the relationship as he may have felt that I was not listening to what he was truly feeling. This would leave the patient in the same state he had entered the experience with. The sources of knowledge that I could use to enhance my relational skills in these areas, is to take the time to practice with a partner a variety of scenarios that would help me develop my communication skills and place more focus on the patients feelings. The outcome of this experience was positive as my patient left feeling more encouraged and had obtained multiple resources to help him incorporate any changes that he may need to adjust within his daily routines (Appendix A). Looking back at this experience I was able to reflect on all of the positiveand negative aspects of a therapeutic relationship. I feel that the next time I am placed in a similar experience, I will be able to blindside my anxiety and personal thoughts and feelings. In turn, I would have the ability to be in the moment with my patients and address not only how I can help solve his problems, but also the feelings and thoughts being experienced. I have learnt that having self awareness identifies what skills I possess and those I need to learn and develop on. Self awareness provides nurses with knowledge of their thoughts, feelings and what they do to become awareness of issues that may affect their ability to intervene effectively (Parsons White, 2008). There will always be room to learn and improve my skills, and with practice, I will get the chance to watch them become second nature to me.This experience has taught me to avoid all the barriers such as the presence of anxiety in new situations. With confidence in creating an effective therapeutic relationship, I can focus on being in the moment with the patient. I have learnt that my anxiety can affect my interactions with patients, and that it is more than trying to solve the patients problems, it is about showing you care and being there in the moment to listen. This experience has allowed me to realize how a nurses action can affect the development of a therapeutic relationship. My ethical knowledge allowed me to recognize my patients overwhelmed feelings due to his health condition and by following my values and beliefs, I knew that he was in need of soul to care and help guide him in the right direction. Using my aesthetic knowledge, I was able to think of possible resources for my patient, and the creative idea of finding a previous heart attack patient showed my patient that I was willing to take that extra step and comfort his feelings. The knowledge gained from this experience can be incorporated into future situations and will allow for proper adjustments and better relationships to be developed. Lacking empirical knowledge before entering the scenario was a barrier that challenged my patient care. Knowing more information on heart attacks would have allowed me to present the patient with more options and what he could expect in the future (RNAO, 2002). Acknowledging my personal knowledge gathered from previous experiences, I considered how I would like to be treated and that anxiety would be present. Knowing this helped me to reduce my fidgeting and respect my patient by actively listening and keeping eye contact (Appendix A). This experiencewill influence my future practice as a nurse because I have learnt that nurse is more than working on fixing the patients physical needs, but is more of an ethical interaction where you can take the time to be there in the moment with them. Looking at each experien ce as a stepping stone toward my success as a nurse and with each successful bank vault crossed, I can confidently await the next.ReferenceBeddoe, A., and Murphy, S. (2004).
